Disclosing Officer Untruthfulness to the Defense in Court proceedings - Research Paper Example An officer is just as a common citizen and should be charged, convicted and punished as any other person. But what if an officer is terminated? Is that punishment enough or more punishment is needed? These big questions have put law enforcement officers in to pressure since they are unable to produce answers to these questions. Many departments in the country have been influenced by the court orders and court decisions that have significant roles when it comes to decision making, serious debates and not forgetting long court wars with the labour organizations revolving around the issue of expectations in policy and disciplinary actions. Reasons for convicting the officer are given herein while reasons for termination only are also produced. The main article revolves around how an officer should be dealt with when he/she does a wrong thing at the work place. Should he/she be terminated only or should he be terminated and punished alongside other punishment? With this questions acting as the main research questions, the paper give satisfied points and decisions on an officer who is supposed to be judged because of his/her wrong doing. The officer is charged with allegations saying that he/she misused the office computers by accessing pornographic media while at work. First he denies such allegations but with further investigation, the same officer is charged with another allegation that his password was used to access unauthorised websites. This time the officer accepts the allegation put against him and begs for forgiveness. With this criminal activity in mind, the paper gives the right decision to be imposed on the officer alleged and also it gives the reasons why the officer was put under such punishment (Maryland, 1963, 83). The U.S justice department has produced necessary instructions on the conduct of the federal law enforcement case which may have local and state police employees involved. This local and state police may have records of untruthfulness in the workplace thus subjected to the instructions provided by the U.S justice department. Several publications including magazines such as the police chief magazine and others have published articles posing discussions on such matters of breaking law. This has led to a number of enforcement departments to provide instructive procedures and rules regarding such matters. Some of these procedures have been published and posted on notice boards and work places. Such publications may include: do not watch or download pornographic movies. But with these signs around the work places, the mission of stopping such criminal activities have not stopped nor reduced at all thus court orders are employed at such situations. Visual Impairment in Alzheimer's Disease The documentation of a severe form of dementia by Alois Alzheimer in 1907 began a massive investigation of the cause of this disorder. Some of the common symptoms of Alzheimer's Disease consist of memory loss, impaired language ability, impaired judgement, and learning (M. Wong, et al. , 1997). Alzheimer's Disease (AD) is mainly a disease of the cerebral cortex. Alzheimer's is marked structurally by the senile plaques, neurofibrillary tangles, and severe loss of neurons and synapses in the cerebral cortex. Alzheimer's is a neurodegenerative disorder ( Hof, Vogt, Bouras, and Morrison 1997). Recent attention has been focused on visual dysfunction in Alzheimer's Disease (K. U. Loffler, D. P. Edward, & M. O. M. Tso 1995). Visual Problems During the clinical evaluation of patients with mild to moderate dementia of the AD type, visual difficulties such as : topographic agnosia, visual agnosia, alexia without agraphia, and prosopagnosia are detected. AD patients have The problem of describing the individual components of a picture is consistent with the severity of cytochrome oxidase (C.O.) deficits in the association cortical areas. Other deficits experienced by AD patients were texture discrimination, blue-violet discrimination, and 4.72 deg/sec motion detection. When AD patients were compared to other age-matched controls, AD patients had shown specific deficits in contrast sensitivity. Deficits in color vision were only age-related (M. Wong-Riley, et al. , 1997). Studies Selective degeneration of large ganglion cell axons was observed in the optic nerves of AD patients, which suggested an impairment of broad-band channel visual function. Although studies show that the broad-band visual capabilities are not selectively impaired in AD. Dorsal LGN studies have shown that both the magno- and parvicellular neurons were greatly affected in AD patients. Strangely, AD patients were impaired at low frequencies instead of the high frequencies, like in old age. This implies that regions controlling the low spacial frequency processing in the primary visual cortex would be affected more than those for high frequency processing (M. Wong-Riley, et al. , 1997). The neuropathologic examination of the brains with visual impairment in the Hof et al. (1997) study revealed cortical atrophy dominating on the posterior parietal cortex and occipital lobe(Hof et al.). To select the employee they conducted interviews hurriedly without paying much attention to the standard way of performing the interviews. After that they directly appoint newly recruited employee, Mr. Anton to perform the job. Mr. Anton missed the opportunity to get proper induction program from the company. Gradually he couldnââ¬â¢t perform the job up to the expected level and it cause to de-motivate the other employee. Due to the improper HR planning, absence of proper strategy to attract employees, improper recruitment, selection and induction Processes Company couldnââ¬â¢t recruit right person to the job. It also caused to lost revenue and orders for the particular product ranges. To overcome the above obstacles the company need to implement effective HR practises within the company. Through proper HR planning, proper recruitment, selection and Induction Company can attract most suitable employee to the company. As a solution for the current situation of the company, they can extend the probation period of Mr. Anton or terminate his job and recruit new employee for the post f brand manager. Both opportunities have their own advantages and disadvantages. In the light of considering the above case its better if they can extend the probation period of Mr. Anton. It was a huge responsibility for the employee because the products are new to the market and need more promotions to market the product in a competitive environment. But the company lost many orders and they had to bear huge cost because of the wrong decisions on the recruitment of the brand manager. Also Mr. Anton missed the opportunity to get proper induction which can identify the surrounding of the practices, policies and the purposes of the organization. Because of the hurry of the company they directly appoint Mr.Anton to perform the job. Due to the improper induction and placement the company couldnââ¬â¢t get the maximum benefit from the particular employee. * De-motivated and frustrated employees due to the poor HR practices The company couldnââ¬â¢t get right employee for the place of brand manager for newly introduced baby soap ranges Due to the improper HR planning, recruitment, selection and placement. In the absence of proper guidance, employees who were under the supervision of Mr.Anton had frustrated minds. Therefore company should attract right candidate with proper qualifications and expertise. For this company can use past annual reports, product manual, websites and etc. One authorised party [marketing manager] can arrange a small company visit and identify the process physically and to identify the other top, middle and lower level employees. This practically causes to increase the confidence level of the Mr. Anton. After the introduction the company can assign little responsibility to Mr. Anton to work on it. There should be a proper guidelines and a continuous supervision on Mr. Anton through this Mr. Anton can learn how the job shou ld be. Perform and with the direct responsibilities of him. He should be advised how to guide a team to achieve the targets. If the Mr.Anton needs more educational qualifications company can sponsor him to get further education. To cost of the training company need to well plan the training program from the beginning to end. On the job training can reduce the cost of training. Because he learns when work. It save the also. Step by step Mr.Anton will perform better and better. It will protect the image of the company, cost and the time. Also companyââ¬â¢s Human Resource department need to be more focus on HR practices. They need to concentrate to gain fresh, innovative, competitive blood to the company. Furthermore company need to assess the performances of the Mr. Anton and need to check whether there is a performance gap. To assess the performance in the probation period company need to record all positive and negative achievements created by the Mr.Anton. Apart from terminate the job of Mr.Anton, extending the probation period increases the confidence level and the mental strengths of him. Deterrence or rational choice, which one is the better, or should I say wiser theory to follow when it comes to the criminal justice system and crime prevention. Using extreme capacitation (Deterrence) can be an effective punishment for many in our society, however, there will still be a small portion of our society that will still commit crimes. The majority of the society would use good-ole common sense (Rational Choice) and not commit crimes in the first place. DISCUSSION: Deterrence and Rational Choice are two theories that our criminal justice system has been in place to prevent criminals from committing crimes.
